Terms of Service

These Terms of Service (hereinafter "Terms") govern the use of the mystartup24 platform, accessible at mystartup24.com (hereinafter "Platform").

The Platform is operated by Provimedia GmbH, Weidenweg 12, 74321 Bietigheim-Bissingen, Germany (Commercial Register: Stuttgart District Court, HRB 723875; VAT ID: DE 255721337).

These Terms apply to all users of the Platform – both registered members and visitors without an account.

Our Privacy Policy and, where applicable, separate agreements for paid services apply in addition.

mystartup24 is an online platform that enables founders and makers to present their tech products and startups to a European audience.

• Submitting and presenting products (Launches)
• Discovering and rating products through Upvotes
• Commenting and providing feedback
• Creating and managing user profiles

The Platform is available in a free basic version and with paid add-on services (Premium Launch, Spotlight).

The usage contract is formed through the following steps:

1. You complete and submit the registration form.
2. You receive an email with a confirmation link.
3. By clicking the confirmation link, your account is activated and the contract is concluded.

You must be at least 16 years old to register.

• Only one account per person is permitted.
• Automated accounts (bots) are not permitted.
• Your information must be truthful and complete.
• You are responsible for the security of your password.

We reserve the right to reject registrations without stating reasons.

The Platform offers the following service tiers:

Free Use (Free Tier)

• Submit products (max. 3 per day)
• Participate in daily launch cycles (20 free slots per day)
• Upvote, comment and discover without restrictions

Paid Services

• Premium Launch (€29 incl. VAT): Priority placement, extended statistics
• Spotlight (€99 incl. VAT): Top placement, highlighted display, maximum visibility

Price changes will be announced at least 30 days in advance and do not apply retroactively to already booked services.

All prices include statutory value-added tax.

• Payment is processed through the payment service provider Stripe. Stripe's terms of service also apply.
• Payment is due before the launch. Accepted payment methods: credit card, SEPA direct debit and other methods supported by Stripe.
• If a submitted product is rejected after payment, we will refund the full amount within 14 days.

You will receive an invoice by email after each payment.

You agree not to misuse the Platform. The following is specifically prohibited:

• Spam, advertising or unsolicited bulk messages
• Manipulation of upvotes (fake accounts, purchased votes, vote rings)
• Distribution of illegal, offensive or discriminatory content
• Use of automated tools or bots without permission
• Circumvention of technical safeguards (rate limiting, captchas)

To ensure fair usage, technical limits apply: max. 100 upvotes per hour, max. 3 product submissions per day.

In case of violations, we reserve the right to remove content, restrict accounts or permanently ban users.

Your Content

• You retain full copyright to your content (texts, images, logos).
• By uploading, you grant us a non-exclusive, worldwide, revocable license to display, distribute and promote your content on the Platform and associated media (e.g., social media, newsletter).
• This license ends when you remove the content from the Platform or delete your account.

Our Content

• Design, logo, code and branding of mystartup24 are intellectual property of Provimedia GmbH.
• Any reproduction, modification or distribution requires our written consent.

Reporting Copyright Infringement

If you believe that content on the Platform infringes your copyright, please contact us at info@provimedia.de with details of the affected content and proof of your authorization.

The following rules apply to product submissions:

• Every submitted product undergoes review (Draft → Review → Approved/Rejected → Featured).
• The product must be a real, functional tech product or startup.
• Duplicates of already submitted products are not permitted.
• The launch date may be at most 4 weeks in the future.
• Logo upload: minimum 240×240 pixels, maximum 3 MB.

We reserve the right to reject or remove products at any time without stating reasons.

• Each registered user can vote once per product (Upvote).
• Upvotes can be withdrawn at any time.
• Technical rate limiting: maximum 100 upvotes per hour.
• Manipulation of upvotes (vote buying, vote trading, fake accounts) leads to immediate suspension.

Comments must be factual and respectful. We reserve the right to moderate or remove comments.

Moderation

All submitted products are manually reviewed before publication. We check for compliance with our usage rules, quality standards and applicable law.

Comments and user content may be moderated after publication if they violate our rules.

Reporting Mechanism

If you find illegal or non-compliant content on the Platform, you can report it:

• By email to info@provimedia.de or via the contact form.
• Please specify the affected content, reason for reporting and any evidence.
• We will acknowledge receipt of your report and review the content promptly.

Decisions and Appeals

When removing or restricting content, we inform the affected user with reasoning.

You may appeal moderation decisions within 6 months.

Certified out-of-court dispute resolution bodies may be consulted.

• We strive to keep the Platform available around the clock.
• Planned maintenance will be announced in advance where possible.
• There is no entitlement to uninterrupted availability.

Statutory warranty rights for digital services apply in accordance with §§ 327 ff. BGB (German Civil Code). We ensure that the Platform meets its contractual requirements and keep it up to date during the contract term.

• We are fully liable for intent and gross negligence.
• We are fully liable for damages to life, body or health.
• In cases of slight negligence, we are only liable for breach of material contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damages.
• Liability for slight negligence is limited in amount to the respective contract value, but at least €500.

For user content, we are liable as a host provider only upon knowledge pursuant to § 10 TMG / Art. 6 DSA.

The processing of your personal data is governed by our Privacy Policy and the provisions of the GDPR.

• We only collect data necessary for the operation of the Platform.
• You have the right to access, rectify and delete your data at any time.
• We only use technically necessary cookies.

• The usage contract is concluded for an indefinite period.
• You can delete your account at any time via account settings.
• After deletion, your personal data will be removed within 30 days. Public content (comments, upvotes) will be anonymized.
• We may terminate the contract without notice for good cause – in particular in the event of serious or repeated violations of these Terms.

If your account is suspended, you will be notified by email and given the opportunity to respond.

Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

Changes to these Terms

We reserve the right to amend these Terms with effect for the future. You will be informed of changes by email at least 30 days before they take effect. If you do not object within the deadline, the new Terms are deemed accepted. In case of objection, you have a special right of termination.

Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.

The authoritative language version of these Terms is German.
